2020年12月起，袁某与“纪总”互发多条诈骗案例的网页链接，商讨可参照制作的诈骗平台。2021年6月，袁某和纪总确定通过搭建虚拟币交易平台实施诈骗，袁某负责提供虚拟币交易平台、租用服务器以及平台修改、测试、完善等技术支持，“纪总”负责寻找客户具体实施诈骗。2021年7月，陈某、洪某等5人明知平台可能被用于诈骗活动，仍帮助袁某对软件进行二次开发。袁某将创建后的新平台交付给“纪总”，该平台于7月中旬投入使用。经查，至案发，该平台骗取多地25名被害人共计人民币1642万余元。本网邀请南通市崇川区第三检察部五级检察官助理陈宝红结合案例和大家谈一谈如何防止电信网络诈骗及其关联犯罪，守护个人财产安全。

In June 2021, Yuan determined that fraud was committed by setting up a virtual currency trading platform, that Yuan was responsible for providing virtual currency trading platforms, rental servers and technical support for their modification, testing, improvement, etc., and that the “Girl Chief” was responsible for looking for clients for specific fraud. In July 2021, Chen and Hung, five people, knowing that the platform could be used for fraudulent activities, helped Yuan to re-develop the software.
苏检君：本案是如何案发的？
Inspector Sioux: How did this happen?
陈宝红：一位热爱理财的股民周某，称其2021年7月至8月期间，跟着一名自称老沈的股票老师投资静待上市的虚拟币，周某一共投资了700余万元，锁资解封日，周某准备出售虚拟币时，发现APP打不开了，发现被骗，立即报警。警方遂立案侦查，并将被告人袁某、陈某、洪某等6人抓获归案。
Chen Bo Hong: , a treasure-loving shareholder, Zhou, stated that between July and August 2021, he had invested in virtual currency to be put on the market with a self-proclaimed stock teacher, who had invested more than 7 million dollars a week, unlocked the funds, discovered that the APP could not be opened, was defrauded, and immediately called the police. The police opened an investigation and arrested six of the defendants: Yuan, Chen and Hong.
苏检君：该案中被告人具体是如何搭建虚拟币交易平台软件的？
Inspector Sioux: How exactly did the defendant build the virtual currency trading platform software in this case?
陈宝红：被告人袁某从网站上下载软件源代码，交由陈某二次开发，陈某找来洪某、詹某等4人根据袁某提供的软件源代码和修改要求，通过修改后台服务器数据、端口链接，删除验证码端口、增加人工客服链接入口和控盘机器人等，创建通过后台可以直接操控涨跌走势、控制被害人充值提现的虚拟币交易平台。平台分为安卓端、苹果端和网页版，制作好后由袁某测试完成后交给纪总上线运营。

苏检君：请介绍一下该案的法律适用情况？
Inspector Sioux: What is the application of the law in this case?
陈宝红：电信网络诈骗犯罪链条较长，行为人之间沟通联络相对松散，对于诈骗罪共犯认定标准往往不好把握，实践中容易出现本应认定为诈骗罪共犯，却以帮助信息网络犯罪活动罪等量刑较轻的罪名处理的情形，导致重罪轻诉、罪责刑不相适应。比如本案中袁某的行为是构成帮助信息网络犯罪活动罪，还是构成诈骗罪引发争议。我们在综合全案证据的情况下认为，袁某事前与纪总商量诈骗项目、诈骗类型、诈骗软件搭建等事项，事中召集人员为纪总搭建虚拟币交易平台，并且根据纪总客户的要求，修改完善虚拟币交易平台，配合纪总关闭交易平台，并主动提出删除服务器数据，袁某明知纪总实施诈骗犯罪，仍为其出谋划策，制作交易平台，配合完善平台信息等，造成被害人1642万余元的损失，构成诈骗罪的共犯。而陈某、洪某等与上家纪总不直接联系，在具体修改制作软件的过程中明知软件可能被用于信息网络犯罪，仍然帮助二次开发，最终软件被用于电信网络诈骗，其行为构成帮助信息网络犯罪活动罪。

We combine the entire evidence with a relatively loose chain of communication between the perpetrators, often difficult to grasp as to the criteria for identifying accomplices to the crime of fraud, in practice it is easy to create a virtual currency trading platform that should be considered an accomplice to the offence of fraud, but that helps to deal with less serious offences, such as the offence of information cybercrime activities, leading to a serious crime and a lack of accountability. For example, in this case, Jin-ho, who knows the offence of fraud, is still preparing a platform for dealing, in conjunction with the development of the information in the platform, to bring about the loss of more than 1,642 million dollars in the victims, which constitutes an accomplice to the offence of fraud. In this case, Chen, Hong-Hung, among others, revised the virtual currency trading platform in accordance with the requirements of the general customers of the discipline, and made an offer to delete the server data.
苏检君：制作软件、提供技术支持是一个中性行为，但是将软件运用于电信网络诈骗，就是常见的虚假平台投资理财类诈骗，该类案件信息技术专业性强，如何对这种犯罪行为审查定性？

陈宝红：首先，审查行为人对电信网络诈骗行为的认知程度。在帮助信息网络犯罪案件中，行为人对电信网络诈骗行为只是概括地认识，并不知悉具体的诈骗类型、诈骗手法等。而在诈骗罪共犯的场合，行为人知晓具体的诈骗内容、诈骗方式等。其次，审查双方意思联络和行为联系的紧密程度。帮助信息网络犯罪活动中，行为人与电信网络诈骗分子之间的联系相对松散、不固定，没有形成相互作用、相互促进的紧密联系。而在诈骗罪共犯案件中，行为人与电信网络诈骗分子之间的联络相对紧密、固定，联络内容相对具体，往往体现为事前通谋或事中勾连，或者至少是“心照不宣”。双方行为之间更加紧密，形成一个相互配合、相互作用的整体。再是审查犯罪所得。诈骗罪共犯案件中，行为人获利较多，直接与诈骗金额相关联，而帮助信息网络犯罪活动的行为获利一般获利较少，与诈骗金额没有直接关联。
苏检君：常见的电信网络诈骗及其关联犯罪有哪些？

陈宝红：司法实践中主要是涉及两卡的刑事案件，涉嫌的罪名主要有帮助信息网络犯罪活动罪、掩饰、隐瞒犯罪所得罪，最常见的形式就是出售银行卡给诈骗分子使用。

苏检君：哪些人群容易触犯电信网络诈骗及其关联犯罪？

陈宝红：第一类是涉世不深的在校学生，他们受老乡、校园周边不法分子蛊惑，出租、出售“两卡”（手机卡、银行卡），沦为工具人。第二类是科技公司从业人员，这类人员抱着赚快钱、侥幸心理，以“技术中立”为挡箭牌，实则沦为“技术助攻”，像本案的陈某、洪某等人就是这种情况。第三类是通信、金融等行业内部人员。他们违反实名制等规定大量办理“两卡”并非法出售、提供，成为电信网络诈骗犯罪主要的工具输送渠道。

The third group is an insider of the communications, finance, etc. who sells and sells “two cards” and illegally, in violation of real names, etc., as the main conduit for the crime of telecommunication network fraud.
苏检君：检察机关为预防电信网络诈骗及其关联犯罪做出了哪些举措？

陈宝红：电信网络诈骗及其关联犯罪严重侵害人民群众切身利益，损害社会诚信根基。我们立足案件，一是强队伍，专案专办，设立专业化的网络犯罪办案团队，同时实现检察+技术协同办案。二是共筑网络犯罪防线，成立南通市金融网络犯罪研究基地，常态化联络56家成员单位，3个专业委员会，充分发挥“外脑团队”作用。三是加强溯源治理，全链条精准打击。注重打击电信网络诈骗及其关联犯罪，通过立案监督、检察建议等，引导公安机关深挖犯罪线索。积极参与“断卡”“净网”“打击治理电信网络诈骗犯罪百日行动”等专项行动和网络黑灰产治理。结合检察长进园区、进项目、进企业行动和“检格+网格”工作联动融合建设，以案例讲述形式开展普法警示，连续4年发布网络犯罪白皮书、召开新闻发布会5次，发布典型案例40余件。
苏检君：警惕电信网络诈骗及其关联犯罪，检察机关还有哪些建议？

陈宝红：一方面，抵制高利诱惑，特别提醒广大计算机专业等技术岗人员在就业择业时要特别留意，所从事的工作内容、沟通方式是否存在隐蔽、规避监管、违法违规的情形，以免被不法分子利用，走上违法犯罪的道路。另一方面，就是不要卖卡，不对外出租、出借自己的电话卡、银行卡，以及微信、支付宝收款二维码等，别让自己的热心肠成为他人的替罪羊，守好钱袋子，护好幸福家。
Chen Bo Hong: On the one hand, resists the temptation of profit, and especially reminds a wide range of technocrats, such as computer professionals, when choosing their jobs, whether there are hidden jobs, forms of communication, evasion of supervision, irregularities, etc., so as not to be exploited by outlaws and put on the path of illegal crime.
